Welcome to www.nailedpolish.com (“Site”), owned and operated by Nailed Polish Ltd (“we,” “us,” “our”). These Terms and Conditions govern your use of our Site and the purchase of products from us in the United Kingdom, United States, and internationally.

By using our Site, you agree to be legally bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Website

You agree to use this Site lawfully and respectfully. You must not:

• Use the Site for fraudulent or unlawful purposes
• Interfere with the operation or security of the Site 
• Attempt to access any portion of the Site you are not authorized to access
   

You must be at least 18 years old or have the supervision of a parent or guardian to use this Site.

2. Orders and Contract Formation

a. Product Availability

All orders are subject to availability. We reserve the right to cancel any order prior to shipping, including in the case of pricing errors or supply limitations.

b. Prices and Currency

Prices are displayed in GBP (£) for UK/International customers and USD ($) for US customers. Taxes (e.g. VAT or state sales tax) are calculated at checkout.

c. Order Acceptance

A contract between you and Nailed Polish is formed once you receive a shipping confirmation email. We reserve the right to refuse or cancel any order.

3. Payment

We accept major debit/credit cards and digital payment providers (e.g., Stripe, PayPal). All payments are processed securely and in compliance with PCI-DSS standards.

4. Shipping and Delivery

We ship to the UK, US, and internationally. Delivery timeframes are estimated at checkout. We are not responsible for delays due to customs, courier service disruptions, or force majeure events.

Shipping charges are calculated based on location and order value. Any duties or customs charges for non-UK/US orders are the responsibility of the customer.

5. Returns and Refunds

You may return unused, unopened products within:

• 14 days for UK and EU customers (in line with the Consumer Contracts Regulations) 
• 30 days for US customers (per our customer satisfaction policy)
   

Returns must be pre-authorized by emailing info@nailedpolish.com. Refunds will be processed to the original payment method. We do not refund original shipping costs.

We do not accept returns of:

• Opened or used products
• Items marked Final Sale or Clearance
• Gift cards or promotional items
   

6. Intellectual Property

All content on this Site (e.g., branding, product names, images, copy, design) is owned by or licensed to Nailed Polish Ltd and protected under UK, US, and international copyright and trademark laws. Use without express permission is strictly prohibited.

7. Limitation of Liability

To the maximum extent allowed by applicable law:

• We are not liable for indirect, incidental, or consequential damages related to your use of this Site or our products. 
• Our total liability to you for any claim shall not exceed the amount paid for the product in question.
   

This does not affect statutory consumer rights in the UK, EU, or applicable rights in the US.

• UK Customers: These Terms are governed by the laws of England and Wales, and any disputes shall be resolved in the courts of England. 
• US Customers: These Terms are governed by the laws of the State of Delaware, and any disputes shall be resolved in that jurisdiction.
